Public Disclosure Requirements: Ensure your Compliance

As an exempt organization, you are required, by law, to have copies of certain tax filings readily available at your place of business. These include:

Form 990/990-EZ/990-PF for the past 3 years

Form 990-T for the past 3 years (if applicable)

Form 1023

If you don’t know where your documents are, there is a way to get copies to ensure you are in compliance:

Form 4506-A – get a copy here (http://www.irs.gov/pub/irs-pdf/f4506a.pdf)

This form can be used by ANYONE, but especially by the Exempt Org, to request public copies of their tax forms. Bear in mind that it can take a few months for the IRS to send the copies, so don’t wait for someone to come in and request to see your copies. You have a legal obligation to provide copies available for review same day. You only have an extra day or two if they want copies that they can take off premise, so waiting can land you in some really hot water. Non-compliance with these legal requirements can actually jeopardize your tax exempt status.
